1. Acceptance of these Terms

These Terms and Conditions ("Terms") form a binding agreement between you and Aromalizz LLP ("Aromalizz", "we", "us" or "our"). They apply when you browse our website, create an account, submit information, place an order, publish content, or use any related service made available by us.

By using the website or placing an order, you confirm that you have read and accepted these Terms, our Privacy Policy, and the Shipping, Cancellation, Return and Refund policies displayed on the website. If you do not agree, do not use the website or place an order.

2. About Aromalizz

Aromalizz is operated by Aromalizz LLP, having its registered address at H/No 005, Unity Village, Dimapur, Nagaland - 797112, India. References to "product" include Aromalizz products offered for sale through the website, including lemongrass and citronella products where listed.

3. Eligibility and Account Responsibility

You must be legally competent to contract under Indian law to place an order. A minor may use the website or purchase only through a parent or lawful guardian. If you create an account, you are responsible for providing accurate information, protecting your credentials and promptly notifying us of suspected unauthorised use. You are responsible for activity conducted through your account unless caused by our failure to apply legally required safeguards.

We may verify contact, delivery or payment information before accepting an order. We may refuse or restrict an account or transaction reasonably suspected to involve fraud, misuse, impersonation, resale abuse or unlawful conduct.

4. Product Information

We aim to present product names, ingredients, quantities, usage directions, warnings, images, prices and availability accurately. Natural botanical products may show reasonable variations in aroma, colour or appearance between batches. Screen settings and photography may also affect how colours appear.

Read the product label, ingredient list, usage directions and warnings before use. Website descriptions are general product information and do not replace label instructions or professional medical advice. If website information conflicts with a mandatory declaration on the delivered package, contact us before use.

5. Essential Oil Safety

Use each product only for its stated purpose and follow the dilution, application, storage and safety directions on its label.

Do not ingest an essential oil unless the product is expressly labelled for ingestion and such use is lawful and professionally appropriate.

Avoid contact with eyes, mucous membranes and sensitive areas. Keep products away from children, pets, heat and flame as instructed.

Conduct a patch test before topical use where the label recommends it. Stop use and seek appropriate advice if irritation or an adverse reaction occurs.

Consult a qualified healthcare professional before use if you are pregnant, breastfeeding, under medical treatment, have allergies or a health condition, or intend to use a product around a child or pet.

Our products are not represented as medicines and are not intended to diagnose, treat, cure or prevent disease unless a specific product is lawfully authorised and labelled for such purpose. Nothing in these Terms removes liability that cannot legally be excluded, including liability arising from a defective product or inadequate legally required warnings.

6. Prices and Taxes

Prices are shown in Indian Rupees unless stated otherwise and include or exclude applicable taxes as disclosed at checkout or on the invoice. Delivery charges, if any, will be shown before you confirm the order. We may change prices prospectively, but a price change will not alter an order already accepted except where the displayed price was an obvious error and the law permits correction.

A coupon, offer or promotion is subject to its published conditions, validity period and availability. Unless expressly allowed, offers cannot be combined, exchanged for cash or applied retrospectively.

7. Orders and Contract Formation

Placing an order is an offer to purchase. An automated acknowledgement confirms receipt, not necessarily acceptance. An order is accepted when we confirm acceptance or dispatch the product, whichever occurs first. We may reject or cancel an order before acceptance because of unavailable stock, an incorrect price or description, payment failure, delivery restrictions, suspected fraud or legal requirements.

If we cancel after receiving payment, we will initiate a refund to the original payment method in accordance with applicable law and the published Refund Policy. Product availability and delivery estimates are not guarantees unless expressly stated as such.

8. Payment

You must use a payment method that you are authorised to use. Payments may be handled by independent payment gateways or financial institutions under their own terms and privacy practices. We do not ask for your UPI PIN, banking password or full card credentials through customer support. Report suspicious payment requests immediately.

An order may be placed on hold or cancelled if payment is unsuccessful, reversed, flagged for review or not received. Any cash-on-delivery option, if offered, may be limited by location, order value, previous order history or operational risk.

9. Shipping and Delivery

Available locations, charges, estimated dispatch and delivery windows, tracking, failed-delivery rules and restrictions are governed by the Shipping Policy shown on the website. You must provide a complete and accurate delivery address and an accessible contact number.

Risk of loss passes as provided by applicable law. Delays may occur because of weather, transport disruption, remote-area serviceability, public restrictions or other events beyond reasonable control. We will not use such events to remove any statutory consumer remedy.

10. Cancellation Returns and Refunds

Order cancellation, eligible returns, exchanges, damaged or incorrect products, inspection, replacement and refunds are governed by the policies displayed on the website at the time of purchase, subject always to mandatory consumer rights. Those policies form part of these Terms.

For hygiene, safety and tamper-protection reasons, opened or used essential-oil products may be ineligible for a change-of-mind return where permitted by law. This restriction does not remove remedies for a product that is defective, damaged, misdescribed, adulterated, short in quantity or otherwise non-compliant with law. Preserve the product, packaging, invoice and clear photographs or video where reasonably required to assess a claim.

11. Reviews and User Content

If you submit a review, photograph, comment or other content, you confirm that it is truthful, based on genuine experience, lawful, non-confidential and does not infringe another person's rights. You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display it for operating and promoting Aromalizz, subject to our Privacy Policy.

We may moderate or remove content that is unlawful, abusive, misleading, irrelevant, infringing, contains personal data, promotes unsafe product use or violates these Terms. We will not suppress a genuine negative review merely because it is critical.

12. Prohibited Uses

You must not:

Use the website for fraud, unlawful activity, harassment, impersonation or infringement.

Interfere with security, attempt unauthorised access, introduce malicious code, scrape at disruptive scale, or overload the website.

Submit false order, payment, delivery, identity, review or grievance information.

Copy, resell, reverse engineer or commercially exploit website content or software except where expressly authorised by law or written permission.

Use Aromalizz products, branding or content to make unauthorised medical, therapeutic, certification or origin claims.

13. Intellectual Property

The Aromalizz name, logos, packaging, website design, photographs, graphics, text, product presentation and other original material are owned by or licensed to Aromalizz LLP and are protected by applicable intellectual-property law. No right is granted except the limited, revocable right to use the website for personal, lawful shopping and information purposes.

14. Third Party Services and Links

The website may use or link to payment, logistics, mapping, analytics, social-media or other third-party services. We do not control their separate websites, availability, security, content or practices. Your use of a third-party service may be subject to its own terms. This clause does not reduce our responsibility for service providers where applicable law makes us responsible.

15. Website Availability

We may maintain, update, modify, suspend or discontinue website features. We do not guarantee uninterrupted or error-free availability. We will take reasonable steps to protect confirmed orders and legally required records during material service changes.

 16. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the website is provided on an as-available basis and implied warranties are excluded only where they may lawfully be excluded. We are not liable for indirect or consequential loss arising solely from website interruption, unauthorised use caused by your failure to secure credentials, misuse contrary to clear instructions, or third-party systems outside our reasonable control.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, defective products, breach of mandatory consumer guarantees, or any other liability or remedy that cannot be excluded or limited under applicable law. Any monetary limitation, if enforceable, will not reduce the refund or replacement rights attached to the affected order.

17. Indemnity

To the extent permitted by law, you agree to compensate Aromalizz LLP for direct losses, liabilities and reasonable costs resulting from your unlawful use of the website, infringement of another person's rights, fraudulent conduct, or material breach of these Terms. This does not apply to losses caused by our own breach, negligence or unlawful conduct.

18. Suspension and Termination

We may suspend or terminate access where reasonably necessary to address fraud, security threats, unlawful conduct or a material breach. Where practical and lawful, we will provide notice and an opportunity to resolve the issue. Termination does not cancel rights or obligations relating to accepted orders, payments, refunds, intellectual property, disputes or provisions intended to survive.

19. Force Majeure

Neither party is responsible for delay or failure caused by an event beyond reasonable control, such as natural disaster, severe weather, epidemic, war, civil disturbance, government restriction, transport shutdown, utility failure or widespread network disruption. The affected party must take reasonable steps to reduce the impact. Mandatory refund and consumer rights remain unaffected.

20. Changes to these Terms

We may revise these Terms for future website use or purchases. The updated version will state its effective date. A material change will not retrospectively alter an accepted order unless required by law or agreed with you. Continued use after an update means the revised Terms apply to later activity.

21. Governing Law and Disputes

These Terms are governed by the laws of India. The parties should first attempt to resolve a dispute through the grievance process below. Subject to any consumer's right to file a complaint before a competent Consumer Commission or other authority in the jurisdiction permitted by law, courts having lawful jurisdiction in Dimapur, Nagaland will have jurisdiction. Nothing here restricts access to consumer authorities, the National Consumer Helpline or another statutory remedy.

23. Severability and Entire Agreement

If a provision is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. These Terms, together with the policies incorporated by reference and the order confirmation, constitute the agreement concerning website use and the relevant purchase. A failure to enforce a provision once is not a waiver of it.

24. Legal Framework

These Terms are intended to operate consistently with applicable Indian law, including the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, applicable legal-metrology requirements, the Information Technology Act, 2000 and applicable data-protection law.
